Terms of Sale

1 The Auctioneers reserve the right to refuse admission to, or eject persons from the Auction premises without giving reason.

2 All lots are sold as seen, with all faults, imperfections, errors of description however caused. No warranty or guarantee of any kind is given on any lot unless expressly stated in the auction catalogue or by the auctioneer at the time of sale. Buyers must satisfy themselves as to the condition of the lot at the time of sale before making a bid. Catalogue descriptions are as supplied to the Auctioneers and are provided as a guide to identification only.

3 Each bidder by making a bid on any lot acknowledges that he is fully satisfied with the condition of the lot at time of sale and the conditions of sale as set out herein, and any amendments to conditions printed / displayed elsewhere, or as made known by the Auctioneers on the day of sale.

4 The highest bidder on each lot shall be the buyer of that lot (subject to any reserve price set by the vendor). At the fall of the hammer each lot shall be at the sole risk of the buyer, but ownership of such lot shall not pass until payment has been made in full to the auctioneers in CASH. At the fall of the hammer, the buyer may be required at the Auctioneers discretion to pay for in full, or pay a deposit against the lot just bought, and if the buyer fails to do so, the lot may be re-offered for sale at once.

5 A Buyers Premium will be added to the hammer price of each lot. Our standard buyers premium is 10%, but this may vary at different auctions. The buyers premium for each auction will be prominently displayed at the auction venue on the day of the auction and notified to potential buyers by the auctioneer before the sale begins.

6 No lot may be removed from the Auction premises until paid for. At the fall of the hammer, all lots are at the risk of the buyer. The Auctioneers shall not be responsible for any loss or damage howsoever caused.

7 An auction bid forms a legally binding contract. In the event of non-payment from a buyer for a lot, the lot shall be deemed unsold and the buyers details shall be made available to the vendor for persual of the defaulting buyer. Details of the defaulting buyer will be made available to other Auction Houses and published in the press at the Auctioneers discretion to help combat fraud. Details may also be passed to credit reference agencies. The Auctioneers accept no responsibility whatsoever on account of the defaulter. The Auctioneers shall not pay out on, or contra against any lot or lots until payment in full has been received from the buyer in CASH

8 The Auctioneers shall not disclose the identity or other information about any vendor or buyer accept under condition 7

9 The Auctioneers have absolute discretion to re-offer a lot which is disputed, divide any lot, combine one or more lots, to refuse bids, stop the Auction, alter the order of the sale without prior notice, or bid on behalf of the vendor subject to any reserve price set.

10 V.A.T. at the current rate is payable on any lots marked with an asterisk (*)

11 Failure to read and understand these conditions of sale shall be no reason for them not to apply to you - see condition 3

12 If you cannot afford to pay for a lot at the end of the sale, please do not bid for it in order to save yourself considerable embarrassment.

13 All persons attending the Auction or any of the appointed pre-view days, do so at their own risk, and shall have no claim against the Auctioneers in respect of any accident, damage, injury or loss howsoever caused. In the interest of serious buyers and for their own safety, children are not allowed in the saleroom.

14 All breakages and damage to lots or the premises must be paid for in full at the reserve price, or at a price set by the Auctioneers if there is no reserve or if the reserve stated is grossly above or below the market value of the item as determined at the Auctioneers discretion.

15 All electrical items are sold as non-working display items only, even though they may well be working in the saleroom. Buyers undertake to have each electrical item they buy tested for safety by a qualified electrician before use. The auctioneers accept no responsibility for the electrical safety of any item offered for sale.

16 Collection / Storage of goods: For auctions held at The Old Elephant House only, free storage of bought lots is offered for 14 days after the auction in order for buyers of larger items to arrange transport. After this time, storage is charged at £1 per lot per day. Goods not collected after 28 days following the auction will be disposed of at the auctioneers discretion, the proceeds used to pay the storage and disposal fees, and any deficit or surplus will be charged or paid to the buyer as appropriate.
